About Us

Civil Litigation Consultancy is the trading name of Kate Bentley, operating as a sole trader in England and Wales.

We provide independent litigation support to individuals and businesses, including case preparation, document drafting, assistance with correspondence, procedural guidance and McKenzie Friend support where appropriate.

Civil Litigation Consultancy is not a solicitors' firm or an SRA-regulated legal practice. We do not undertake activities reserved to authorised legal professionals unless legally entitled to do so.

Our Services

The services described on this website are intended to provide practical assistance to individuals and businesses dealing with disputes, legal proceedings and related matters.

The nature and extent of our involvement will depend on the circumstances of each case and the services expressly agreed with the client.

We reserve the right to decline enquiries or instructions where a matter falls outside our expertise, capacity or permitted scope of assistance.

Initial Enquiries

Prospective clients may submit an initial enquiry through our Discuss Your Case form without charge.

This allows us to consider the nature of the matter and whether our services may be suitable.

Submitting an enquiry does not create a client relationship, constitute acceptance of instructions or place Civil Litigation Consultancy under any obligation to undertake work.

We do not undertake a detailed assessment of the merits of a case as part of the free initial enquiry.

Case Reviews

Where an enquiry is considered suitable for further assessment, the client may be invited to proceed with a paid Case Review, currently charged at £125.

The Case Review involves consideration of the relevant facts and documentation, identification of the principal issues and an assessment of the practical options and next steps available.

The precise scope of the review will be confirmed before payment is requested.

Payment for a Case Review does not constitute an agreement to undertake further work or provide ongoing assistance.

Telephone Consultations

Telephone consultations are available for £75, payable in advance through our website.

Following payment, we will contact the client within one working day to offer available appointment times, subject to availability.

The appointment will be confirmed once a mutually convenient date and time have been agreed.

A telephone consultation provides an opportunity to discuss the circumstances of a matter and consider potential next steps. It does not include a full documentary Case Review, preparation of legal documents or ongoing case assistance.

The duration and scope of the consultation will be confirmed before the appointment.

Telephone consultations are subject to our published Cancellation & Refund Policy.

Further Work and Fees

Where further assistance is appropriate, we will confirm the proposed scope of work and applicable fees before accepting instructions.

Fees may be fixed or quoted on a bespoke basis, depending on the nature and complexity of the matter.

No additional chargeable work will be undertaken without the client's agreement.

Any separate engagement terms supplied in relation to specific instructions will apply alongside these website terms. Where they conflict, the specific engagement terms will take precedence, subject to applicable law.

Client Responsibilities

Clients are responsible for providing accurate and complete information, disclosing relevant correspondence and documents, and informing us promptly of any court hearings, procedural requirements or deadlines.

Unless otherwise lawfully agreed, clients remain responsible for the conduct of their own proceedings, including the issue, filing and service of court documents.

Submission of an enquiry or purchase of a service does not suspend court deadlines, statutory limitation periods or other legal time limits.

Court Proceedings and McKenzie Friend Assistance

Where McKenzie Friend assistance is provided, it will be subject to the applicable law, procedural rules and directions of the relevant court.

A McKenzie Friend does not automatically have the right to address the court, examine witnesses or conduct litigation on behalf of another person.

Any assistance with hearings or proceedings will be limited to the scope of support permitted in the particular circumstances.

Outcomes and Limitations

We approach each accepted matter with care, diligence and a commitment to identifying the strongest practical way forward.

However, litigation and dispute resolution are inherently uncertain, and no particular result or outcome can be guaranteed.

Nothing in these terms excludes or restricts liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation or death or personal injury caused by negligence.

Confidentiality and Personal Information

Information supplied to Civil Litigation Consultancy will be handled with appropriate care and confidentiality, subject to applicable legal obligations.

The collection, processing, retention and disclosure of personal information are explained in our Privacy Policy.

Cancellation and Refunds

Cancellations, rescheduling requests and refunds are governed by our Cancellation & Refund Policy and applicable consumer law.

Governing Law

These terms are governed by the law of England and Wales, without affecting any mandatory consumer protections that may apply.
